Millerstown Borough Council Meeting Minutes June 1, 2026 Those in attendance: President Rob Shipp, Vice President Kevin Hertzler, Council members Rich Fegley, Tim Ritzman and Donna Showers. Mayor John Kerns, Secretary Karen Knellinger, Plant Manager Jared Wagner and Operator Brycen Little. HRG Engineer Isaac Underhill, Solicitor Bill Dissinger and Zoning Officer Tim Reilly. President Shipp called the meeting to order at 7:00 pm. Public and Private Concerns Sign ins: None The minutes from the regular meeting were emailed and reviewed. Vice President Hertzler made a motion to approve the minutes as presented. Councilmember Fegley seconded the motion. Approval was unanimous. The bills/receipts/expenditures were reviewed and discussed. Councilmember Ritzman made a motion to approve the bills as presented. Councilmember Showers seconded the motion. Approval was unanimous. Street Committee Report The street paving and patching bids were reviewed with the results as follows: Mike Cleck $56,000 M&J $48,750 J&T (Formerly Pavemasters) $69,250 Rt 333 (Fulkroad) $88,495 Chair Fegley asked Jared if the bids were based on the same specs to each contractor since the bids are so far apart in price. Jared assures all the specs were the same and all of the same like kind and quality materials and depth of material. Councilmember Fegley made a motion to approve the lowest bid from M&J Paving for $48,750. Councilmember Showers seconded the motion. Approval was unanimous. The pothole on School Street was coned off due to a residential complaint and will remain until paving takes place. The awarded contractor will be contacted and a date scheduled. HRG will advise when this work is scheduled. The pigging of the main line will be at a later date following their completion. The sampler is being repaired, a new motor was installed but the samples are not being picked up correctly, Jared will have Burns come back out to fix it. Water Committee Report The Asset Management Plan meeting with DEP is scheduled for 6/10/26 at 10am as a Teams Meeting. The invitations will be sent out from DEP to attend. Dave will be helping out with some history on some equipment. The new reservoir water meter has been installed and is operational. It is all electronic and any replacement parts will be available from LB Water. Finance Committee Report The DCED audit has been approved for the Borough and the Municipal Authority through DCED. Solid Waste Committee Report One customer was missed. Solicitor’s Report Solicitor Dissinger presented the draft for Ordinance #2026-03, data centers. Since this is a legitimate use, they must have provisions of where to put them and in what zoning district. He suggests the commercial or industrial district although just the industrial district may be too small. A provision must be made or risk overturning by a judge and any open area could be used. Many issues have been raised across the State concerning high levels of noise, electric and water consumption. Council reviewed the draft and suggest the quiet times be moved to 10pm-8am and to leave in the commercial and industrial districts. This will need prior approval from TriCounty and advertised before adoption. Secretary Knellinger will include the adoption for the August meeting of Borough Council. Solicitor Dissinger has been in contact with the County for the upset tax lien sale of properties. Engineer’s Report Isaac advises no new land development plans. Genesee Valley Construction has a few items on their list to complete. They presented an application for payment in the amount of $204,715 for the Cipp lining and work completed so far. Approval was unanimous. Isaac will have the information to Secretary Knellinger for the payment request details to submit to CFA. The total project funding from CFA is $425,000 with a $15,000 match from the Municipal Authority. The next step, after this phase is completed, is the cleanout of the force main. Isaac will be compiling bids for that phase of the project to be presented at the next meeting. Jared commented the I&I seems to have gotten better since the lining and the flows are down. The Consumer Confidence Report will be ready soon and will be sent out with the quarterly bills before the July 1st deadline. Zoning Permit Zoning Officer Reilly advised one permit was issued for a pergola and slab at 604 Poplar Street. Mayor’s Report None Old Business The Primary elections were held at the Borough Building and went well. New Business Secretary Knellinger was in contact with the School District concerning shredding. The cost is prohibitive for them to pick up boxes however; if we deliver to Harrisburg it is free. There are several requirements to follow before transport. Vice President Hertzler sent a records retention requirements for Pennsylvania for reference of what can be destroyed. A Hometown Survey is available from PeCo EDA. The Farmland Bureau sent a letter concerning data centers. Councilmember Ritzman made a motion to adjourn. Vice President Hertzler seconded the motion. Approval was unanimous. The next meeting will be held on Monday, July 6th at 7pm.
